We are currently runing our RBGM's in KwaZulu Natal. We have pleasure to announce that the Lower South Coast Region which was the first run a successful RBGM succededed in pushing the bounds and setting new standards. Other regions are expected to follows suit.
All of our RBGM's will be addressed by COSATU leadership, including GS Cde Zwelinzima Vavi,President Cde Sdumo Dlamini, Provincial Secretary Cde Zet Luzipho and SACP Provincial Secretary Cde Themba Mthembu.

DSADTU LOWER SOUTH COAST(KZN) 7th RBGM DECLARATION
We the delegates of SADTU from the 13 branches of Lower South Coast Region representing 7946 members met at Gamalakhe FET College in our 7th Regional Biennial General Meeting, which was a great success on the 4th to the 6th of July 2011 declare and committed ourselves in continuing to be loyal and disciplined members of SADTU and in the struggle for the total liberation of the working class and the total destruction of the barbaric and evil system of monopoly capital. We further declared and committed ourselves to protect, defend and consolidate the alliance and its components against the new tendency that is driven by narrow wealth and profit accumulation greed, crass materialism, tenderpreneuarship and deliberate distortion of our progressive and revolutionary programs.
In our discussions and deliberations we noted the following:
- the brutal and criminal way in which our fore-fathers were disposed of the mineral wealth of their country,
- the Freedom Charter as the document that is biased to the working class
- the National Democratic Revolution as a minimum program and the shortest route to Socialism
- the resolution of the Morogoro Conference of the ANC in 1969
- the Medium Term Vision of the 12th Congress of the SACP held in Port Elizabeth
- the resolutions of the COSATU Central Committee held at Galagah Estate on the 28-31 June 2011, which exposed, based on the research conducted by Naledi, the three related factors confronting the working class which are :
.. Deepening poverty
.. Deepening inequality and
.. High rate of unemployment with the youth comprising 72% of the unemployed.
- The forensic report issued by the KZN Department of Education in regard to the corruption allegations made by SADTU against some high ranking Departmental Officials.
We further noted that:
- the economy of our country remains intact as it was during apartheid rule and as the economy that still depicts the Colonialism of a Special Type,
- that the economy of South Africa remains the economy that serve the narrow interest of the petty bourgeoisie and the few leaders, their families and cronies,
And we resolved, committed and declared ourselves to the following:
POLITICAL ISSUES
We reaffirmed our commitment to political and union education for our members. That we defend, protect ,d consolidate the Alliance and its components and allies. That our members must continue to swell the ranks of the ANC and to actively participate in the SACP. That we must open a debate on how do we deploy to the state and on how do we monitor those deployed to ensure that they continue advancing the interest of the working class.
We call upon the office of the Minister of Higher Education and the office of the President to release all newly appointed staff members who are implicated in the forensic report by Ngubane and Associates. The MEC of KwaZulu Natal to take action with immediate effect to implement the recommendations of the report. That the current economic structure be restructured such that it is biased to the working class and to develop programs which will demonstrate our impatience towards the economic structure and our DEMAND For SOCIALISM.
ORGANISATI0NAL ISSUES
That we consolidate and improve on membership recruitment particularly from the vulnerable sector and to have clear recruitment programs and to develop and capacitate our leaders from Site Stewards up on organisational and administrative capacity. To improve on membership benefits. Better resourcing of our structures particularly branches.
MEMBERSHIP SERVICE AND VISION 2030
That we develop programs to enhance membership service and create a working class culture in our Region. That copies of the constitution be made available to all members.
GENDER STRUGGLES IN EDUCATION
That we further re-committed ourselves in the fight against HIV/AIDS and the campaign on circumcision and all other gender struggles.
That all schools should be provided with auxiliary services such as psychologists, school nurses, social workers and other necessary staff members. That we put a program together with the Department of Education to fight against teenage pregnancy and teacher child sexual relationships. That we develop a program to ensure that basic hygiene necessities are provided in schools such as sanitary towels for school girls. That career guidance be given at schools and programs be developed to encourage girls to pursue careers that would have ordinarily be dominated by males.
EDUCATION
That we fight for the abolition of all anti-transformation policies of the Department of Education. That the NCS be implemented and educators be capacitated through the Curtis Nkondlo Institute. That there should be full service schools/institution in all departmental wards. That all schools. Should be provided with basic and necessary facilities to provide quality public education. That we take a campaign to transform disadvantaged schools in regard to subject offerings and options. That all subjects must have Education Specialist.
SOCIO-ECONOMIC and FINANCE
That we resuscitate our campaign and our call for free and compulsory education. That all schools must be provided with learner transport, feeding schemes, workbooks, libraries and all necessary programs to support quality public education. Re-affirm our commitment and demands for reopening of all colleges for re -skilling as was adopted by the 52nd ANC Congress. Re-affirm our commitment to the campaigns for job creation and fight against corruption. That we support the decision of 5th CC of COSATU to fight for a living wage which includes a social wage.
CONCLUSION
To this end we commit ourselves and the newly elected leadership to these resolutions as our two year program.

The South African Democratic Teachers Union in KZN is excited with and feels vindicated by the decision of the learned Judge J. Retief wherein he had dismissed Ilanga news papers application for leave to appeal the original decision of the Ombudsman dated the 6th OF May 2011, as he was of the view that there was no reasonable prospect that the SAPAP may come to the decision different to that of the Ombudsman.
The findings against ILanga were:
• Unfairly damaging SADTU’s reputation by presenting allegations as facts ; and
• Not asking this organization for comment.
On the 6th of June 2011 the Ombusman directed ILanga newspaper to carry out its findings as set out here above.
This follows a callous, irresponsible and a crudely un-researched article, devoid of veracity. This malicious article was published by a certain Wellem Phungula of ILanga news papers. The highly mendacious innuendos’ appeared to have been the well concocted disinformation campaign which emanated from the conspiratorial plot by some of aggrieved clique who are the cronies of the very same Wellem Phungula.
The image of ILanga has been brought into question as well as the stature of the people who are within its employ. As SADTU we have resorted to an unrelenting stance of riding our society of irresponsible reporting like the one in question and even go to the extent of helping those who are vulnerable and gullible. Our responsibility is to protect the innocent and unsuspecting people of South Africa from ferocious jaws that are acrimoniously generating blatant lies for sensationalism and for the purposes known only to themselves.
This recent decision by the Judge will be subjected to a special PEC Meeting which will take place soon and decide on approach to be taken towards ILanga. Once the decision is taken we will lobby COSATU, in particular, and other alliance partners to support us in whatever decision we shall have taken in this regard.

SUMMARY OF DECISIONS OF THE PROVINCIAL CHAMBER MEETING HELD ON WEDNESDAY, 23 MARCH 2011
1. The Employer shall recommend to their principal that the process of reinstatement temporary educators be speeded up by using dedicated officials and would request them to work overtime as from 24 March 2011.
2 The Employer would also ensure that administrative processes for reinstatement shall be completed by Monday, 28 March 2011, in time to satisfy a cheque run the following Thursday, 31 March 2011.
3. The issue of displaced educators be referred to the Dispute Prevention Committee to conduct necessary research and investigation, particularly with a view to amending Resolution 8 of 2008 in finding practical and workable methods to deal with the placement of displaced educators.
4. It was agreed that the filling in of promotion posts which remained vacant due to problems encountered by the SGB’s be referred to the Staffing Committee for discussion and formulating recommendations to fill these posts.
5. The Employer shall issue a circular by close of business on 23 March 2011 to clarify/state the necessary qualification requirements for advertised posts in compliance with the provisions of the PAM Document.
6. The Employer agreed to table the issue of surplus educators at the forthcoming workshop to which organized labour would be invited.
7. Structure of Chamber
7.1 STANCO shall assume the role of the Special Task Team to oversee and monitor the functioning of Chamber and shall intervene to resolve any impasse that may occur between Parties. The representation at STANCO shall be three representatives from organized labour and three from the Employer, ideally comprising of leaders from Parties.
7.2 QLTC shall be a standing item on STANCO’s agenda.
7.3 Other Committees of Chamber shall be:
Staffing Committee – to include dealing with issues of ECD and ABET
Dispute Prevention – to include dealing with the issue of displaced educators
Teacher Development
The employer and organized labour shall be entitled to six representatives each with organized labour represented in terms of applicable vote weights.
8. A meeting would be convened under the auspices of the ELRC between the Employer and organized labour. The Employer shall revert to the Provincial Secretary on a suitable date and ensure that necessary personnel were in attendance to present and respond to queries from organized labour.
9. Grievance Handling
9.1 An urgent meeting be held with the General Secretary of the ELRC to discuss the implication of recent case law/judgment in respect of lodging of promotion disputes.
9.2 The Dispute Prevention Committee drafts a code of good practice/rules of engagement in respect of grievance handling for onward recommendation to Chamber.

EDUCATION SUMMIT DECLARATIONS 2011
Preamble
We, the delegates attending the KwaZulu-Natal Education Summit 2011 comprising of a multi-sectoral representation from National Departments of Education (DHET & DBE), KwaZulu Natal Department of Education, National and Provincial Departments, Organised Labour formations, School Governing Bodies, Representative Council of Learners, Higher Education Institutions, Non-Governmental Organisations, Business Sector and legislative bodies with an interest in education gathered on the weekend of 11th – 13th of February 2011 at Chief Albert Luthuli International Conference Centre in Durban under the theme:
“Building the Quality of Education towards Improving Learner Performance”
The Summit recognised the need to debate the concept of “People’s Education for People’s Power” and it’s meaning in the current context.
The Summit which was characterised by robust, frank, honest and constructive engagement was informed by the following documents:
1. Ready to Govern : “People’s Education for People’s Power”
2. Polokwane Resolutions
3. Education for All
4. Millennium Development Goals
5. Medium-Term Strategic Framework
6. Action Plan 2014: Towards the Realisation of Schooling 2025
7. MEC: Mr E S Mchunu’s opening address to the Summit
The Summit among other matters deliberated on the following issues:
• Curriculum implementation, management and support challenges;
• Systematically synergizing and improving education management at all levels;
• Maximising the utilization of all available resources, i.e. doing more with less;
• Improving learner performance by addressing barriers to learning and vulnerabilities faced by learners;
• Forging partnership with relevant stakeholders to strengthen the quality of education; and
• School leadership, management, administration and governance challenges and the improvement of school functionality
The Summit understands that:
The KwaZulu Natal Department of Education is constrained by limited human and material resources needed to mitigate all the identified challenges; the Department does however, have the opportunity to develop unity of purpose with all relevant stakeholder, to galvanise and synergise efforts, to harness the available resources and to work tirelessly towards the achievement of our common goals.
The Summit believes that:
• The Department has the requisite desire to strive for excellence in education;
• The journey forward has been mapped out by policy injunctions such as “Action Plan 2014 – Towards the Realisation of Schooling 2025” and supported by political will, and
• It is not alone in this journey for it has the benefit of the wisdom of it fellow travelers, its social partners in education; and
• It can do much more with less.
The Summit acknowledges and appreciates that:
The platform was a glorious opportunity for the Department and esteemed stakeholders to continue its journey on the road to deliver quality education to all the people of the province.
The Summit resolves that:
The overarching vision for South African education system – People’s Education for People’s Power shall remain as a political yardstick to measure the radical progress we make in the transformation of the education system as a whole and the total emancipation of our people.
The vision of the Department “A well-educated and highly skilled citizenry” must at all material times inform the kind of programmes and campaigns we develop in building the quality of education towards improving learner performance.
The Summit declares on the following:
A. CURRICULUM MEDIATION
“That the efficient and effective mediation of the curriculum needs a combination of both teacher competency and resource allocation”:
The Summit resolved that the Department must develop a new affordable but qualitative approach to issues of teacher development. Hence a rigorous programme, particularly in the gateway subjects of Mathematics and Science, must be developed and implemented as a matter of urgency.
The Summit resolved that the Department, together with stakeholders must work on creative means to diversify the curriculum offered in previously disadvantaged schools and support such diversification with the necessary resources.
On Literacy and Numeracy, the Summit called upon the Department to analyse the Annual National Assessment (ANA) results, identify obstacles to quality curriculum delivery and have practically implementable programmes to address the gaps in the identified areas.
The Department, working with appropriate organisations and stakeholders, must create a programme to practically develop the indigenous languages (spoken in KZN) to the same corpus level as the English language.
B. LEADERSHIP AND MANAGEMENT
The Summit resolved to capacitate all managers at all levels to understand and work towards the realisation of the shared vision of the KwaZulu Natal Department of Education..
All management structures and components must have planning, monitoring and reporting tools to ensure effective and efficient management, supported by appropriate and visionary leadership.
The Summit resolved that in order to improve efficiency, effectiveness and accountability, financial functions must be devolved to responsibility managers in the Department and that a risk management system be put in place to manage risks.
C. LABOUR PEACE
The Summit recognised that the implementation of the summit resolutions needs an environment of labour peace and stability. To secure labour peace, the call has been made for the Department, Organised Labour and other stakeholders to work towards the creation and maintenance of labour peace and stability in the Education system.
The Summit impressed upon both the Department and labour to work towards the revitalisation of the KZN Education Labour Relations Council as the vehicle to promote labour peace, stability and progress.
To that effect, the Summit called upon the Department to ensure the implementation of the principle of decent work starting with the filling of all vacant posts in the system.
D. SUPPORT PROGRAMMES
Summit noted the conditions under which support staff work and urged the Department to value and appreciate the contribution of support staff in achieving the vision and mission of the Departmental. The Summit further requests that programmes be designed to ameliorate the difficulties experienced by support staff. The Department must consider support staff as an integral part of the larger Departmental corps striving for excellence in service delivery.
The Summit acknowledged and expressed appreciation for the Department’s role in implementing support programmes for educators, governing bodies and learners, and calls upon its leadership to intensify and extend programmes such as the National School Nutrition Programme and HIV and Aids awareness programmes to all school.
E. INFRUSTRUCTURE
The Summit noted the spatial under-development of KZN and the effect it has on the delivery of quality education. Summit calls upon the Department to explore alternate ways to accelerate the delivery of education infrastructure. In the interim the Department must ensure that the distribution of available resources is biased towards the poorest communities.
F. THE ROLE OF STUDENTS
The Summit appreciated the historical role played by student organisations to bring about quality education for all with a special emphasis on those previously disadvantaged by Apartheid education. The current epoch of a single education dispensation, advancing the interest of all learners is as a result of the struggles of learners both past and present. The Summ

SADTU PEC had an urgent meeting with top officials of the department on 16 March 2011 and expressed its anger and dismay at the continued deductions that took place after the agreement of a moratorium on deductions had been reached on 28 February 2011. SADTU believes that there is someone in the department that has a political vendetta against the ANC led department. SADTU demanded the immediate suspension of the acting Centre Manager. The department agreed to investigate the matter and committed itself to taking action against anyone found guilty of such an allegation. SADTU also demanded that the department wrote letters of apology The department agreed to: 1. Reverse all the deductions of the 8000 teachers including those that belong to the teacher association that went to court. SADTU fought for them too and won. 2. Write to all individual members of SADTU who were deducted and apologise for such a transgression on the department’s part.
Update on No Work No Pay

SADTU KZN has concluded an emergency meeting with the DoBE concerning the deductions made to member salaries in March. These deductions were done despite a moratorium being declared on NWNP. Sadtu views this as intransigence on the part of the Department and demands the following: 1. An investigation into why the system failed. 2. A refund of deducted monies. 3. A letter of apology to Sadtu and affected SADTU members.

Yesterday 10 March 2010 SADTU Provincial leadership had a meeting with the SG and his top officials and the following agreements and decisions were taken: ON ABET •SADTU informed the department that ABET practioners have had their tariffs underpaid since 2006. SEE ATTACHED CORRESPONDENCE ON TARRIFS. •The union demanded that the amount owed since 2006 be paid retrospectively to individual practitioners. The department agreed that the analysis of how much is owed be made available so that a decision on payment can be made. Meanwhile SADTU insisted that while the docier is being compiled practitioners tariffs must be paid correctly at least retrospective to January 2011. RECOGNITION OF CENTRE MANAGERS ADMINISTRATION WORK •SADTU informed the department that the department, has without consultation, unilaterally reviewed payments for centre managers such that their ten hour payment on Fridays had been reduced and they are paid 8 hours only. The department conceded to the manipulation and undertook to correct that immediately. PAYMENT ACCORDING TO THE NUMBER OF HOURS PRACTITIONERS SPEND AT THE CENTRE. •SADTU informed the department that practitioners complained that they are paid 1 hour instead of 2 hours that they spend at ABET centre. The department indicated that if that happens it would be a mistake and they undertook to correct it. PAYMENT ON A MONTH TO MONTH BASIS •SADTU expressed its serious discomfort with the departments claim system which results in the practitioners not being paid timeously. SADTU negotiated for payment of the practitioners on a monthly basis and on PERSAL like the mainstream teachers. The department agreed in principle to that suggestion and suggested that a commission consisting of both SADTU and the department must a create a user friendly method by which the department will not be incurring unnecessary expenditure. The commission will sit soon and expect to be updated soon. OTHER ISSUES •Other issues with regard to this sector like the issue of the bonus or payment in December and during vacation are yet to be discussed in detail between SADTU and the department both nationally and provincially.

ECD/ GRADE MATTERS •Salary increment/ living wage. •SADTU put forward her proposal about this years’ grade R increment proposal for R2000 meaning that GRADE R practitioners must be paid R5000 this year. •The department acknowledged our demand and requested time to go and consult with the powers that be. FOLLOW UP MEETING •The union and the department agreed to hold a follow up meeting somewhere next week so that we can resolve a number of problems facing GRADE R workers and ECD workers in general, issues like bursaries, qualification, absorption, permanency, benefits, etc. PUBLIC SERVICE ACT EMPLOYEES (CLERKS, SECURITY, CLEANERS AND GENERAL WORKERS.) •Because of the sophistication of this sector, the union and the department agreed to a meeting between SADTU and HRM as well as HRS in order to tackle all problems pertaining to PSA employees QUALITY TEACHING AND LEARNING PROGRAMME •SADTU and the department agreed to have a meeting in two weeks time to agree on how the skills levy can be disbursed to finance our QLTC. FINANCE BRANCH •The union and the department agreed to have a work session wherein the finance branch will be accounting as to how exactly finances are disbursed and to what programmes. We want them to tell us how finances have been used for the financial year 2009/2010 and how they intend using the over R33 billion allocated for 2011/2012 financial year.. THANDILE RISK SERVICES (THE LEAVE MANAGEMENT AGENCY) •SADTU and the department acknowledged all problems caused by Thandile and agreed to have an urgent meeting sometime next week between SADTU, the department and Thandile wherein we will have to tackle all problems caused by this management agency. TEACHER ASSISTANCE •SADTU wanted to know how many teachers assistants are in the province and under what act are they employed and why their services were terminated at the end of last year. •It was agreed that an urgent meeting must be held between SADTU and HRM so that we together recall the contextual framework informing the creation of these posts as well as establish processes and procedures that will inform continued employment as well as the increase in the number of teacher assistants. RURAL INCENTIVES •SADTU wanted to know how many teachers are presently enjoying the rural incentives. •The answer was they are a little over 10 000 and that about R70 million is remaining unused. There was a serious concern about the formula/ approach that is being used to disburse the incentives. SADTU suggested a way of shortening this unnecessarily long winded process by stating that the remaining R70 million must be disbursed to identified deep rural areas in a more quick and efficient way avoiding the delaying technicalities. The urgent chamber meeting will be called to ratify that decision and the same chamber would agree on the areas that must benefit with immediate effect. DCES/ SEM ISSUE •After having been briefed by some SEM’s about what they referred to as the possible downgrading of SEM’s salary package, the union reluctantly requested the department to shed some light on this controversial question? The acting SG indicated that he didn’t know about such and that he therefore did not instruct any lawyer of the department to raise such. He however undertook to consult or to contact the national department of education and request a directive from them. HRM 88; 89 / 99 OF 2010 AND HRM5 OF 2011 •The department agreed to instruct lonely and astray Umzinyathi ill-informed director to withdraw the misleading circular with which he wants to terminate the services of UTE’s and that was going to be done with immediate effect. SADTU informed the department that it would make a submission for this director to be charged for poisoning the labour environment. Meanwhile SADTU and HR will meet to take stock of the progress made in the implementation of the above circular. GARNISHEE ORDERS •The committee consisting of the department and SADTU will sit soon and tackle the issue of unknown emolument /garnishee orders meted against our members. Expect an update on an ongoing basis on the matter. THE MEC APPEALS COMMITTEE •SADTU expressed its discomfort and disappointment by the consistent, observable failure by the above committee to sit and observe the issues of appeal. The department agreed to consult the MEC’s office with the suggestion that this committee must sit on a monthly basis and must respond efficiently to allow quality time for members to take educated decisions about the outcomes of the appeals process. POST SUMMIT MEETING •SADTU expressed her concern about the noticeable delay on the part of the department to call for a post summit so that stakeholder may synthesizes the outcomes of the recent summit and agree on programmes and possible projects for the implementation of the summit decisions. SADTU suggested that the summit meeting must precede the education MEC’ budget speech. CLEARING THE NO WORK NO PAY CONFUSION •Our previous circulars have reference. •In those circulars we indicated that SADTU had agreed with the department of education on the 28 February 2011, which was last Monday to put a moratorium on the application of no work no pay principle from March onwards until certain important technicalities are attended to. •Please find attached the letter written by the department on the 02 March 2011 confirming SADTU’s media statement on the moratorium. •However we note that a certain opportunistic teacher association (after learning about what SADTU and the department had agreed upon) , and knowing that it was likely lose its members, should they learn of this SADTU gain, decided to pollute the environment by taking the matter of no work no pay to court. We hope this clarifies SADTU’s position on now work no pay. In summary no more deductions from now (11 March 2011 till further notice).
